Condition of Use.
1. NO SMOKING INSIDE THE HALL.
2. NO HOOKAHS INSIDE OR OUTSIDE AT ALL TIMES.
3. YOU NEED TO SPECIFY ON THE CONTRACT WHAT KIND OF CEREMONY THE CUSTOMER IS DOING.
4. ETHIO UNITED WILL NOT PROVIDE ANY SECURITY GUARDS AT ANY TIME - BUT CUSTOMER CAN HIRE FROM OUTSIDE COMPANY.
5. CUSTOMER IS RESPONSIBLE FOR ANY DAMAGES DUE TO ANY FIGHTS INSIDE OR OUTSIDE THE HALL.
6. ETHIO UNITED WILL NOT PROVIDE ANY DECORATIONS.
7. CUSTOMER WILL BE CHARGED FOR THE EXTRA TIME OVER 9 HOURS OF ALLOTTED TIME.
8. CUSTOMERS ARE REQUIRED TO CLEAN THE HALL WITH NO TRASH LEFT AND WILL BE CHARGED FROM THE DEPOSIT IF MUCH WORK REQUIRED AFTER THE PARTY.
9. ETHIO UNITED WILL NOT PROVIDE ANY SOUND SYSTEM, BUT WILL PROVIDE CERTAIN DISCO LIGHTS.
10. ETHIO UNITED NEED $1000.00 SECURITY DEPOSIT BEFORE A CUSTOMER CAN BOOK THE HALL.
11. BANQUET HALL NEED TO BE CLEANED, AND THE KEY HANDED NEXT MORNING BY 10:00AM. CHARGED OF $100.00 EACH HOUR AFTER 10:00AM

Empire Banquet Hall SPECIAL EVENTS AND VENUE CONTRACT This contract defines the terms and conditions under which Empire Banquet Hall, and ("hereinafter referred to as the "client") agree to the clients's use of Empire Banquet hall facilities on (event date). This contract constitutes the entire agreement between the parties and become binding upon signature of both parties. This contract may not be amended or changed unless executed in writing and signed by Empire Banquet Hall and client. This contract shall be considered void if not signed and returned within two weeks of issuance. 2. Facilities provided by Empire Banquet. Empire Banquet Hall will provide the following facilities on the dates and time indicated lower level (approx. 5000 SF) and surrounding grounds restrooms with flush toilets (ADA compliant). 3. Venue rental initial deposit at the time of signing a contract. Payment of the remaining balance of the entail fee is due 30 days in advance of the event. Deposit and payment will be made by certified, or bank check made payable to Empire Banquet Hall on the schedule noted. 4. In the unlikely event that the client should cancel this contract, all deposits are non-refundable. The client shall not assign or sub lease any terms, conditions or services contained in this contract or any interest therein with the express written consent of Empire Banquet Hall. If for any reason Empire Banquet Hall is unable to fulfill its obligations under this contract, all deposits will be returned to client. 5. Scheduled payment amount date due initial deposit $: ______ Remaining balance 30 days before the event: _________________________. The initial deposit of $ ______ is to secure your date and is non-refundable. Damage/ Excessive cleanup deposit in addition to the venue rental deposit, a damage/ excessive cleanup is required in the amount of $1000.00 and is due the same as the final payment set forth in paragraph 4 (a) above. Empire Banquet Hall is a result of clients’ use of the premises or any relating to the event. If extra labor and/or cleanup is required as a result of clients’ use of the ‘Empire Banquet Hall’s facility, clients agree to pay for such items at the below agreed upon labor for set. Up for decorations or to assist in set ups if client requests such assistance. $50.00/hour per person labor to clean up unnecessary mess such as vomit, alcohol spill or other liquids, or extra restroom cleanup from client’s guests lack of personal responsibilities or hygiene. $50.00 occurrence damages to facility in any form will be photographed by Empire Banquet Hall, and a formal repair/cleaning cost invoice will be submitted to the client along side any remaining balance of client’s damage deposit. If the damage and/or excessive cleanup exceeds the deposit amount, the client will be invoiced for the repairs and extra cleanups the following rates; $50.00/hour per person. The remaining balance if any, of client’s damage and excessive cleanup deposit will be refunded by Empire Banquet Hall within 14 days following the event or 14 days following completion of repairs and/or cleanup. Cancellation and Refund of deposits. 7. If the client wishes to change the date of the event, every effort will be made by the Empire Banquet Hall to transfer reservations in support of the new data. The client agrees that, in the event of data change, any expenses included but not limited to deposits and fees that are non-refundable are the sole responsibility of the client [see paragraph 5 for non-refundable fees]. The client further understands that last minute changes can impact the quality of the event and Empire Banquet Hall is not responsible for any compromises in required by all clients and is due no later than 30 days prior to the event. This insurance must, at client’s sole expense, provide and maintain public liability and personal property damage insurance, insuring Empire Banquet Hall and its employees, contractors and contracted vendors against any bodily injuries, property damage and personal injury and other loss arising out of clients use and occupancy of the premises, including appurtenances to the premises, sidewalks, road walks and roadways. The insurance required, hereunder, shall have a single limited liability of not less than $1 million and general aggregate liability of not less than $2 million. Empire Banquet Hall shall be named as an additional insured on said policy. If alcohol is to be served, please make sure that the policy includes Host Liquor Liability coverage to protect you against any alcohol related accidents, as you are ultimately liable to the safety of your guests. Established catering services may use their license and insurance to cover this requirement. All caterers and/or institutions must provide a copy of their Certificate of insurance and Catering license to Empire Banquet Hall, as an additional insured. These documents must be delivered at least 30 days prior to the event. Failure to provide evidence of these insurance 30 days prior to the event, may lead to immediate cancellation of the entire event. Cancellations arising from clients’ failure to provide a proper and timely certificate of liability insurance will be treated as a client-caused cancellation. 8. Clients agree to indemnify, defend Empire Banquet Hall and hold harmless its landlord, building owners, officers, employees and agents from any liabilities, costs, penalties or expenses arising out of and/or resulting from the rental and use of the premises, including but not limited to their personal guarantee of provision, service and dispensing by client, its employees and alcoholic beverage at Empire Banquet Hall. The client also agrees to indemnify and hold harmless Empire Banquet Hall and its officers, agents and employees against any and all liability, claims, actions, demands or losses of any kind of nature that may occur or be claimed with respect to any person or persons, corporation, property or chattels on or about Empire Banquet Hall or to the property itself resulting from any act done, or omission by or through the client, its agents, contractors, employees, invitees or any person on the premises by Empire Banquet Hall reason of clients use or occupancy thereof. These may include but are not limited to; accidents, injury or property damage arising from an act of the client’s guests, whether intentional or negligence during use. Clients agrees to pay all costs and attorney fees incurred by Empire Banquet Hall, its owners and representatives in defending any such claim or action brought against Empire Banquet Hall, its owners and/or representatives. In the event Empire Banquet Hall, its landlords, building owners, officers, employees and/or agents are required to file any action in court in order to enforce any provision of this contract, client agrees to pay Empire Banquet Hall’s officers, landlord, building owners, employees and/or agents all reasonable attorney fees, court costs and costs of suit incurred by Empire Banquet Hall including all collection expenses and interest due. Any suit brought by the client or Empire Banquet Hall with regards to any claim related to any aspect of this contract must be brought in the judicial district of Dallas County, TX. Rules and Regulations. 9. The following is a list of rules and regulations to be upheld by the client, which includes all event planners, wedding coordinators and vendors who are involved in the planning and execution ofa special event or wedding on the premises of Empire Banquet Hall. Security. 10. Empire Banquet Hall does not accept any responsibility on damages or loss of any articles or properties left at the premises prior to, during or after the event. The client agrees under the client’s control and direction. At all events, Empire Banquet Hall will appoint a representative to be in charge of the event, opening and closing the building and be available during the event. Certain events that end after dark will be required to have security personnel present. Empire Banquet Hall is not responsible for security, all security costs are the responsibility of the client. Client agrees that Empire Banquet Halls staff may enter and exit the premises during the course of the event. A representative of Empire Banquet Hall will be on site during the entire event and will be checking the restrooms, overall premises, replenishing hand towels, toilet papers etc., and will be available for questions or to respond to any needs or issues that may arise at anytime during the event. Alcoholic Beverages. 11. As the host of the private party, client should acknowledge responsibility for the proper and lawful consumptions of alcohol beverages at the premises during the duration of the event described in this contract. Alcoholic beverages will be purchased and served through a no foul or abusive language or obscene gesture, no intoxication or other signs of impairments related to alcohol consumption. Use of illegal drugs or other illicit substances is not permitted. Violators will be escorted from the premises. Physical violence of any kind will not be permitted, no obscene or indecent clothing, no use or possession of weapons of any kind. Empire Banquet Hall is a “tobacco free” environment. Smoking is not permitted in or near Bannockburn Barn, the restroom trailer or other structures. Smoking is permitted in dinged areas only. No open flames are permitted in or near Bannockburn Barn area. Fire extinguishers are provided in the venue area by Empire Banquet Hall. All vendors and caterers are required to be knowledgeable in the use and location of fire extinguishers at our facility. Our staff will identify locations and use of fire extinguishers. Final Empire Banquet Hall door closing time. 12. All events must end not later than 2:00AM, loud music must end by 2:00AM, catering services licensed in the state of Texas to sell and serve alcohol beverage. Alcohol beverage cannot be self-served. The catering service and its agent will exercise due care in serving alcohol beverages and will refuse service to any person appearing to be under the age of 21 or any persons who appear to be intoxicated. Identification and proof of age will be required from any person who appears to be under 12 years of age. Alcoholic beverage will be removed from anyone believed to be a minor or from any intoxicated person. The catering service or its agent will provide all alcoholic beverage consumed in accordance with the laws and regulations of the State of Texas, client shall monitor all service of alcohol and specifically acknowledge that client is solely liable for the consumption of any alcohol by any person on the premises and that such liability shall extend to any aspect regarding the consumption of alcohol. Empire Banquet Hall reserves the right to ask the entire party to leave if; i) A minor is consuming alcohol ii) An adult providing alcohol to a minor iii) A guest or guests appear intoxicated and refuses to leave the premises. Empire Banquet Hall must receive proof in advance that you or the person contracted by you have valid license and permits issued by the commonwealth of State of Texas for selling and/or serving alcohol beverage. The clients agree to fully cooperate with the assist Stone of Empire Banquet Hall. The catering service and its agents in enforcement of the beverages. Vendors staff may not consume alcoholic beverages while on the premises during the event. 13. Empire Banquet Hall is a small free facility. Open flames, frying or other cooking is not allowed in or near the barn as our facility is not ventilated. Smoking is not permitted in any restroom. If smoking materials are discarded in planters, on sidewalks, roadways or grounds, an extra cleanup charge will be imposed. Any guest violating the smoke restrictions will be asked to vacate the premises by the event staff. Catering. 14. Stone of scone farm, LLC reserves the right of final approval of all outside caterers and any other vendors selected for the event, if the client selects a caterer that is net to our facility. That caterer must meet with our events manager to familiarize themselves with the facility’s rules and to view the facility. All caterers must provide proof of public liability insurance, including the expiration date, the policy limits and the name of the insurer, at least 30 days prior to the date of the events. All caterers must also have the necessary license and permits required by the State of Texas, City of Dallas, Health Department and any other regulations before the event date. Said caterer is to immediately provide the listed items above to Empire Banquet Hall. If no caterer can be found that satisfies the above-described requirements before the event, the client will still be liable under this contract. Empire Banquet Hall catering room is a production space and is to be used only for final food preparation, plating and bussing. The facility does not provide dishes, glassware, pots, pans, knives, utensils, etc. The catering room space will be provided in a clean condition and should be returned to a clean condition immediately following your event. The caterer is expected to sanitize all food preparation surfaces before they come into contact with food products. Proper hygiene is required at all times. All food must be covered at all times prior to plating and bussing. A walk through of our catering member of our staff is mandatory prior to the event and at the close of the event. All trash including sorted recyclable and properly sorted compostable must be collected and properly bagged. Failure to properly clean the catering area will result to additional charges to the client. Empire Banquet Hall proudly commits to a zero-waste event. In addition to the foregoing, the caterer is responsible for the cleanup of the dining arears. Please allow sufficient time for cleanup of all designated areas at the conclusion of the event. Catering trash especially food and drink debris may not be left for cleanup the following morning. All events trash must be disposed of in designated areas at the conclusion of the event. The facility wants to make every event here a special experience. Therefore, every effort will be made to allow the client to prepare and install decoration reflecting their creative requirements. Only the staff members of Stone of Empire Banquet Hall will rearrange and move any furnishings including but not limited to artwork, lamps, antiques, tables and seats. The cost for our staff to move the objects is included in our rental fee. Staples and other penetrates items may be used to secure decorations on our wood surfaces only with the express permission of Stone of Empire Banquet Hall, no flitter or foil confetti is allowed on site as it is extremely difficult to clean up. Only low tack tape is allowed on our floors, walls and ceilings. All decorations must be removed without causing any damage to our facility, no items may be hanged from or attached to lighting fixtures or electrical outlets and switches. Ladders may be used for decorating by the client. The facility reserves the right of final approval for all decorations brought into the facility. In particular, for safety reasons, any item capable of creating an unsafe environment will not be allowed e.g., fireworks, sparklers, open flames, sharp objects, etc. The use of birdseed and blowing bubbles is permitted outside the facility only for wedding reception farewells. Rice, confetti, glitter, pyrotechnics and sparklers are not permitted inside or outside the facility. Rehearsals. 15. The client is welcomed to use the venue for a ceremony rehearsal prior to the wedding. However, the ceremony rehearsal time must be approved by Empire Banquet Hall and must be scheduled so that it does not interfere with any other event. Music and Entertainment. 16. Please be aware that if the clients event creates a disturbance due to high noise volume, Empire Banquet Hall on site manager has the full authority to ask the clients DJ or live music provider to turn the entertainment volume down and/or if repeated disturbance occur, sole discretion, the client may be expelled from the premises, or the offending noise will be ended. In the event of any disturbance to the point of expulsion, no portion of the event cost will be refunded. Loud music is allowed only inside the ball room. Additional music time may be added beyond 2:00AM provided the volume is modest and it cannot be heard beyond the boundaries of the property or by immediate neighbors, DJs, bands and musicians. Children. 17. The client is responsible for ensuring that music providers understand that all children under the age of 16 must always be supervised and attended by adults. Unforeseen events. 18. Clients agrees that Stone of Empire Banquet Hall and its officers shall not be liable for losses and damages including attorney’s fees court costs and consequential damages, detention, delay or failure to perform in whole or in part resulting from causes beyond its control, including but not limited to acts of God, weather condition, fire, power outage, strikes, riots, embargos, details in transportation, inability to obtain supplies or requirements, or regulations of the united states government or any other civil or military authority [To include any local legislation regarding liquor fully responsible for all expenses relating to the rental car and any other vehicle involved in any type of accident]. Insurance. 19. The renter hereby agrees that he/she shall be held fully responsible for in case of any accidents. The renter also agrees that the vehicle is covered under the TF Express insurance. The renter also agrees that personal belongings and other items left in the vehicle at any time are note covered. Return of vehicle. 20. The renter hereby agrees to return the above-described vehicle to the pick-up location not later than December 20th. Jurisdiction. 21. The parties’ consent that this is a legal binding document in the State of Texas.
